Custom Product Ordering Policies and Procedures

These Custom Product Ordering Policies and Procedures are subject to change without notice.
Definitions and or also known as
Hamilton's Woodcraft also known here after as (capital letters or non capital letters) 'HW", "I", "our", “my” or "me", "we". "Our" meaning I get help from time to time from a partner (designated or accepted at will at anytime).
Wood Products are sold as is.

Personalized Wood Products have a 25% fee. the personalization needs to be approved. Criteria for approval are as follows. Space available on a product being personalized, no vulgarity or profanity (determined at my sole discretion). Also acceptable according to our Terms and Conditions.
Personalization is an engraving or added material on top of any Already Design product. The personalization can be letters, words, phrases, designs or something that can be added to a product that has already been designed. The product in most circumstances will not be already built. sometimes it is possible to personalize a product that has already been built, but not always.
Personalization is not the same thing as Customized here at Hamilton's Woodcraft. A Customized product here at HW means that the product itself, the dimensions, shapes, material used and other related factors have been designed and tailored to precise specifications approved by a customer and built.

Custom Wood Products will be either a New Design or an Exclusive Design. More information regarding Custom Wood Products below. Custom Wood Products does not mean that the product must be made from wood only. A lot of times other materials may be introduced to the final product.

Viewing Orders in queue
Paying Customers may view orders we have in queue and their status. Some orders display detailed information. Not all orders can be viewed. Exclusive Designs (orders) are kept from the public. Also any request to keep information about an order to be made private will be respected.

Design types
There are 3 design types that we refer to as; Already Designed, New Design or Exclusive Design. There are distinctive differences between these 3 types of designs. A design that is Already Designed refers to any design that has already been designed for another customer that purchased a New Design and did not purchase an Exclusive Design. A New Design is a New Design that any customer may purchase from HW that is specifically made for that customer. An Exclusive Design is an Exclusive Design for the customer that purchases that design. Furthermore the customer will maintain the rights to the design exclusively, they may keep all design notes, drawings and files created by HW. No other person or entity should be shown the design other than the customer or any one the customer shows. HW will not share this design with any other person, company, business or entity of any kind to the best of abilities. HW intends to turn over all notes to the customer unless the customer has no desire for the notes or files. If the customer decides not to accept the design notes and files and material related to the design into their possession, then HW will maintain the design notes, files and materials discreetly.

Already Designed
When a customer purchases a New Design and HW completes their order. The design that customer purchased is kept by HW for business purposes and it may be put into plans and put up for sale as plans or may build products by that design for other customers. Already Designed were New Designs at one time and those designs and or plans are subject to resale and other business needs.
New Designs
A customer may purchase a New Design, which will be designed to the customer's liking. HW and the customer discuss and discover the details and refine designs until an agreement is reached and the customer is ultimately satisfied with the final design. Then HW either releases the design to the customer or commits to building the product based on the design and type of purchase that was agreed on. HW reserves the rights of any "New Design" that HW and the customer agreed HW to design as a New Design. HW reserves the right to build products based from this design and sell them to other customers. All New Designs are subject to becoming Already Designed designs that may be sold with plans or used to build products that HW may sell. Each New Design for a customer is named after that customer that discussed and discovered the design with HW. The names of other designs rely on for whom the design was intended for or when the design was created or discovered by HW.
Exclusive Designs
An Exclusive Design is similar to a New Design, except the customer reserves the rights to the design. HW will not copy any Exclusive Design for another customer. HW will not sell Exclusive Designs or plans or products from these designs to any other customer except for the customer that reserves all the rights to the designs and the product built from the design. All notes, files, images, video and drawings HW created and/or used to complete and fulfill an order of an Exclusive Design will be turned over to the customer during fulfillment. However the customer may request that HW hold onto the designs. If HW holds onto these designs for any customer, they will stay in the possession of HW and HW will be responsible for not disclosing it's contents to any one else in the foreseeable future. Please note and consider that there may be instances of files copied that might be beyond HW's control. Then carried by third parties and so on. Although for the sake of confidentiality HW will give it's due diligence to keep the designs and related notes kept private within reason. Exclusive design fee is 100% of product price figured by HW at HW's discretion as if it were a New Design. So if it were a New Design and I price it at $100, then and Exclusive Design would be $200. These designs are usually not cheap to start with as they are also usually sophisticated and surely one of a kind. Exclusive Designs and products from these designs are not listed or shown on this site or anywhere else by HW, no matter how remarkable they are.

Design Process
Discussion then design. We talk about what you want and I get an idea of what that is then commit to a design and usually right away. Designs can take days to weeks depending on various factors related to the design and my schedule. Once I have a design that I believe meets your wants, I'll present that to you. Often I'll present more than one design to just speed things up a bit. I'll often go back to the drawing board until you are completely satisfied with all the details of the design. Once you are completely satisfied with the design, the design process is complete.
An honest heads up. There are occasions where designs may need to be altered due to unforeseen circumstances in the design. If this happens, I'll contact you to discuss this. This can happen when things won't go as planned in the build process and that sometimes does happen.

Ordering Custom or Personalized Products Process
Step 1
Discussion
All orders begin with the discussion. The discussion starts with a customer requesting what they want or maybe just asking questions or may have been referred to by a friend or coworker and you or they are curious. However, I may also ask someone what they want even if they didn't inquire about any products. Either way a discussion takes place when I'm speaking to anyone about something they want whether its a new customized product or something that is to be personalized.
Step 2
Design
Designing something new (Custom Product). This design process has a couple sub steps. I work closely with you during the design process collecting details and discovering your ideas assembling them into one or more design/s, then I will present the design/s to you. We refine the design/s until you're satisfied. Once you are satisfied with a design an agreement must be made.

If you're ordering something that has already been designed or even built, then Step 2 goes much faster and it's likely a personalization then. If not a personalization either, then we skip Step 2. We have an online store where you can order what we have displayed right away. These orders will also get added to our Order Queue.
Step 3
Agreement
Paper work will get signed and a deposit of 50% of the agreed upon price takes place. Once a deposit is made, your order is officially placed. After that I commit to building the product. Your order is then added to an Order Queue. Once all preceding orders have been completed and delivered to our customers, we start building your order per our agreed design/s and any other agreement/s.
Step 4
Build
I build your brand new custom designed or personalized product.
Step 5
Fulfillment
After your product is built, we'll contact you and let you know. At this point you may inspect the product since it is a fresh, brand new custom made product and you are the first buyer. You may waive your right to inspect the product, although we encourage you to inspect the product. Once accepted and the product passes your inspection or you have waived your right to the inspection. You then must pay the remaining balance due to purchase the product for the total price we agreed on. Then either you pick up your brand new product at the shop or I deliver it to you personally (Delivery fees may apply). Also products may be shipped from my shop directly to you.
Thank you,
Scott Hamilton
